Lege Nr. 58 din 29-03-2012 privind protejarea patrimoniului cultural imaterial

The legal framework for identifying, documenting, researching, conserving, transmitting, promoting, revitalising, and valuing intangible cultural heritage in the Republic of Moldova is established by Law Nr. LP58/2012. The law aims to protect intangible cultural heritage as part of the national cultural heritage, cultivate respect for the intangible cultural heritage of communities, groups, and, as applicable, individuals to ensure recognition of heritage values at the local and national levels.

The law recognizes the role of local public administration authorities in protecting the intangible cultural heritage of their communities. It requires them to adopt measures to ensure that traditional creations of communities remain authentic and unchanged. The law mandates a partnership between local authorities and the central authorities of the state for the inventorying, documenting, researching, conserving, transmitting, and promoting of cultural heritage. The legislation emphasises the importance of revitalising disappeared elements of cultural heritage that are significant to community identity.

Intangible cultural heritage bearers, including individuals and groups, play a critical role in preserving their cultural heritage, and the legislation provides them recognition and support from the public sector. All physical and legal entities are required to submit their proposed plans for interventions that could impact the traditional elements of the intangible cultural heritage for evaluation by the Ministry of Culture to ensure heritage viability. The law prescribes penalties for contraventions, with punishments ranging from disciplinary or civil sanctions to criminal offences.

Overall, the law takes a proactive and inclusive approach to conserving the culture of the Republic of Moldova. It requires the active involvement of stakeholders in both state and non-state public sectors. The law aims not only to preserve cultural heritage but also to promote and enhance its value as a driver of regional economic and social development while championing the continued existence of heritage expressions in their authentic forms.
