Law 5037/2023 provides provisions for the Waste, Energy and Water Regulatory Authority, for the use and production of energy from renewable energy sources, provisions for renewable energy sources and environmental protection and incorporates EU Directives 2018/2001 and 2019/944.
In particular, the provisions of the first Section (Part A) regulate the issues of the renaming of the Energy Regulatory Authority (ERA) to Waste, Energy and Water Regulatory Authority (WERRA), as well as issues of organisation and operation of the Authority. Additional provisions for strengthening water policy are set out (Part B of Section A) as well as issues relating to the competences, organisation and implementation of the National Water Strategy. In the second Section of the Act (Part A), regulations are introduced on issues relating to renewable energy sources (RES), self-consumption/self-production of electricity from RES plants and high-efficiency cogeneration of electricity and heat, RES in the transport and heating/cooling sectors, as well as issues relating to common support schemes and RES projects, and citizens’ energy communities.
Among other things, the provisions on the framework for joint cooperation with EU Member States and/or third countries for the purpose of undertaking electricity generation projects are amended (Articles 71-72). Provisions are introduced to ensure that a minimum percentage of transport fuels is derived from renewable energy sources (Articles 74 and 76), specific rules for biofuels and biomass fuels produced from food and feed crops, and provisions on sustainability and greenhouse gas emission reduction criteria for biofuels, bioliquids are amended. Furthermore, a framework for the integration of energy from renewable sources in heating and cooling is introduced, with reference to measures to be included in the National Energy and Climate Plan (Article 83).
The Act amends provisions of Law no. 4414/2016 on power plants from RES and CHP from self-consumers. It also amends provisions of Law no. 4685/2020, 4951/2022, 4819/2019 concerning waste, packaging, packaging waste and plastic products, as well as Law no. 3199/2003 on water protection and management and harmonisation with Directive 2000/60/EC of the European Parliament.
