Nόμος 4067/2012 (79 / 02-04-2012): Νέος Οικοδομικός Κανονισμός

Article 6 of Law 4067/2012 – the New General Construction Code (NOK) – refers to the definition and protection of architectural heritage.

Designation and protection of Listed Buildings: It extends the ‘subject’ of protection, stating that individual buildings or parts of buildings or building complexes, as well as elements of the surrounding environment (e.g. courtyards, gardens, doorways, and fountains) as well as individual elements of urban (urban or rural) equipment (e.g. squares, fountains, walkways, and bridges), may be designated as listed buildings. The law states that it is possible to amend or revise the existing urban planning scheme, for the protection, restoration, preservation, and enhancement of the traditional urban fabric of traditional settlements, even if this results in a reduction of the area of public spaces. The agreement of the local Architectural Council is required to approve Building Permits for new buildings or additions to existing buildings on properties adjacent to listed buildings.

Interventions on Listed Buildings: An exception to the coverage percentage for the addition of electromechanical equipment can be granted with the agreement of the Architectural Council. Properties that have been classified as listed are reconstructed based on documentation of their original form. In case of demolition due to risk of collapse, special provisions for reconstruction apply.

Exceptions from Thermal Insulation Regulations: Non-application of the KENAK (Energy Performance of Buildings Regulation) is allowed for listed buildings to preserve their architectural value, with a decision from the Architectural Council.

Law 4067/2012 aims to protect the built or non-built environment and its natural resources and innovates in terms of its environmental sensitivity, the protection of natural and architectural heritage and urban land, natural resources and available urban spaces. Articles 224, 225 and 226 regarding parking places were amended by law 5037/2023.
