Decreto-Lei n.º 101-D/2020, de 7 de dezembro: Transposição das Diretivas (EU) relativas ao desempenho energético dos edifícios e à eficiência energética (Decree-Law no. 101-D/2020, of December 7: Transposition of the (EU) Directives on the energy performance of buildings and energy efficiency)

This decree-law defines the requirements applicable to the design and renovation of buildings in order to ensure and promote the improvement of their energy performance and regulates the Energy Certification System for Buildings (SCE), transposing EU Directive 2018/844 and partially transposing EU Directive 2019/944.

The legislation focuses on regulations related to energy performance, certification, and monitoring in buildings. It establishes that buildings must maintain a minimum level of energy performance, and if they fail to do so, they are required to submit and implement an Energy Performance Improvement Plan. The aim is to promote sustainability, energy efficiency, and the transition to renewable energy sources while reducing greenhouse gas emissions.

The Clean Energy Package is highlighted as a key initiative to achieve these goals. It includes mandatory certification for new buildings and major renovations, with specific documentation required to demonstrate compliance. Energy performance assessments take into account various energy needs within buildings, ensuring that they meet the necessary standards.

Non-compliance with energy performance requirements is addressed, emphasising the responsibility of building owners to rectify any issues promptly. Additionally, the decree-law mandates that energy certification must be displayed in certain buildings and public entities to inform and raise awareness about energy efficiency.

Overall, this decree-law sets out a comprehensive framework to regulate and monitor energy performance in buildings, with the ultimate goal of promoting sustainable practices and reducing environmental impact. By enforcing these regulations, the government aims to drive the adoption of energy-efficient measures and contribute to a more sustainable and environmentally friendly built environment.
