Act amending the Act on the Protection of Cultural Assets in Denmark

The proposed amendment to the Danish legislation on the safeguarding of cultural assets aims to strengthen measures against the illegal import of cultural goods. This legislative update introduces stricter penalties and enforces supplementary provisions aligned with the European Parliament and Council Regulation (EU) 2019/880, concerning the import and entry of cultural items.

A key element of this amendment is the enhancement of Chapter 5, which now encompasses comprehensive penalty provisions. This includes the authority for customs and tax administrations or the police to detain shipments suspected of containing illegally exported cultural goods. These authorities will coordinate with the Ministry of Culture to assess the legitimacy of such items and their adherence to both national and international laws.

Additionally, the amendment emphasizes the importance of protecting Denmark’s cultural heritage by ensuring that imported cultural goods comply with the legal frameworks of their countries of origin. This legislative change is crucial for preserving the integrity and historical significance of cultural artifacts, deterring illicit trafficking, and ensuring compliance with international standards.
