Règlement grand-ducal du 9 mars 2022 fixant la composition et le fonctionnement de la commission de circulation des biens culturels

This legislation establishes the composition and functioning of the Cultural Goods Circulation Commission in Luxembourg, aiming to safeguard the country’s cultural heritage. The commission, consisting of eleven members with expertise in cultural heritage, is appointed by the Minister of Culture for renewable three-year terms. The President, Vice-President, and Secretary of the commission are designated by the Minister, with a focus on maintaining confidentiality and integrity in handling cultural heritage matters.

The commission convenes to deliberate on cultural heritage issues, with decisions requiring a simple majority vote of the present members. The transparency of the decision-making process is emphasised through recording votes and potential dissenting opinions. Additionally, the involvement of experts in specific cases is permitted to ensure informed discussions and recommendations. Members are obligated to maintain confidentiality regarding discussions and information related to heritage matters, including experts’ involvement.

Meetings are scheduled in advance, with the agenda integral to the meeting notice, promoting efficient and organised discussions. In cases where members have personal interests in agenda items, they are required to abstain from deliberations. The legislation also outlines procedures for member substitutions in case of absence or vacancy. Overall, this regulatory framework aims to facilitate the preservation and responsible management of Luxembourg’s cultural heritage through structured decision-making processes and expert involvement.
